GENERAL CONTRACTUAL CONDITIONS

We hereby present the contractual document that will govern the purchase of products and services through the website https://lacroixe.com, owned by Guest Dress, SL (hereinafter the provider or La Croixé BCN). Acceptance of this document implies that the user:

  1. He has read, understands and comprehends what is stated here.
  2. That is a person with sufficient capacity to hire.
  3. That assumes all the obligations set forth herein.

These terms and conditions will have an indefinite period of validity and will apply to all contracts made through the provider's website https://lacroixe.com .

IMPORTANT: The provider reserves the right to unilaterally modify these Terms and Conditions, without affecting goods or promotions purchased prior to the modification. Furthermore, unless otherwise indicated, telephone or fax/modem calls will be charged at the same rate as local calls, and therefore will not exceed the basic rate.

IMPORTANT: Pursuant to Law 12/2003 of November 24, which amends Law 4/1997 of July 9, on Drug Prevention and Assistance, as amended by Law 1/2001 of May 3, Article 1 prohibits the sale or supply of this product to minors under 18 years of age. This prohibition does not apply when the sale or supply to individuals over 16 years of age is documented for the professional use of the product. In the latter case, La Croixé BCN must be legally notified of this documentation by any verifiable means.

This merchant agrees not to permit any transaction that is illegal or that is considered by the credit card brands or the acquiring bank to be potentially damaging to their goodwill or to negatively impact them. The following activities are prohibited under the card brand programs: the sale or offering of any product or service that does not fully comply with all laws applicable to the Buyer, Issuing Bank, Merchant, Cardholder, or cards.

Identity of the parties

On the one hand, the provider of the goods or services contracted by the user is Guest Dress, SL, with registered office Calaf, 10, 08017, Barcelona (Barcelona, ​​Spain), NIF B66620352.

The user, whether registered on the website or not, is responsible for the accuracy of the personal data provided to the provider.

 

Subject of the Contract

The purpose of this contract is to regulate the contractual relationship of purchase and sale created between the provider and the user at the moment when the latter accepts the corresponding box during the online contracting process.

The contractual relationship of purchase and sale involves the delivery, in exchange for a price that is determined and publicly displayed through our website, of a specific product or service.

 

Procurement procedure

The procurement procedure may only be carried out in Spanish. If it can be carried out in another language, this will be indicated before the procurement procedure begins.

To access the services offered by the provider, users must register through the website by creating a user account. To do so, users must freely and voluntarily provide the required personal data.

The user will select a username and password, committing to use them diligently and not to make them available to third parties, as well as to inform the provider of their loss or theft or of possible access by an unauthorized third party, so that the provider can proceed to block them immediately.

The user may not choose as a username words that are intended to confuse others by identifying him as a member of the provider, as well as offensive, insulting and generally illegal expressions or expressions contrary to the requirements of morality and good customs.

Once the user account has been created, please note that, in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow these steps:

  1. Add items to your shopping cart. You must specify the quantity of each product. The purchase must be over 10 euros.
  2. Ordering method. The user must place the order as a guest or registered user.
  3. Billing details. Selection of shipping address and delivery territory.
  4. Payment type (card / transfer).
  5. Check and place your order. Click on “I have read and agree to the terms and conditions” to complete the ordering process.
  6. Payment information.

 

In any case, the provider's contracting platform will inform the user, once the contracting process is complete, about all the characteristics, price, shipping methods, contracting date, and estimated delivery date of the product or service purchased. Likewise, the user will receive an email confirming their order.

 

Proper access to the online store depends on the telecommunications system used and in particular the internet network, therefore the Company is not responsible for interruptions, delays or errors of the service due to causes beyond its control, as well as those derived from the equipment and/or connection to the Client's network.

 

Order delivery

Orders will be delivered to the address freely designated by the user. If, upon receiving your order, one or more of the products are unavailable or out of stock, we regret that we will not be able to fulfill your order completely. In this case, we reserve the right to choose between partially fulfilling your order or rejecting it entirely. We will inform you immediately by email if we choose to cancel your order.

If the goods you have ordered are available, the delivery time to the address you have indicated – delivery time – during normal business periods is 48-72 working hours, starting from the receipt of your order.

The provider assumes no responsibility when the delivery of the product or service is not made as a result of the data provided by the user being false, inaccurate or incomplete or when the delivery cannot be made for reasons beyond the control of the shipping company assigned for this purpose, such as the absence of the recipient.

Notwithstanding the foregoing, the provider shall take the measures required of a diligent merchant to ensure that delivery can be made within the agreed time, and if that is not possible, as soon as possible, to the satisfaction of both the sender and the recipient, and therefore no liability may be imputed against the provider.

 

Price and validity period of the offer

All prices shown for goods in the online store include current Value Added Tax (VAT) and any applicable fees, and are always expressed in Euros (€). In addition, we will invoice you for shipping costs for each order, which may vary depending on the order placed and the delivery location.

The prices applicable to each product will be those published on the website and will be automatically applied during the final stage of the checkout process. The customer acknowledges that the price of some products may change in real time. In any case, this will always be communicated to users beforehand.

All payments made to the provider will result in the issuance of an invoice in the name of the registered user upon completion of the purchase process. This invoice may be automatically sent to the email address provided by the user, as well as included with the purchased product, should the user require it.

Payment methods

Regarding the retention of title, until the full price is paid, the goods delivered will remain the property of La Croixé BCN.

Please be advised that, depending on your terms and conditions with credit institutions or other financial entities, you may incur additional charges for transfer fees, account management, etc. We recommend that you contact your bank or credit card issuer for further information. The provider guarantees that no charges will be applied for the use of the aforementioned payment method.

We reserve the right to restrict the use of the above payment methods to one or more options on an individual basis.

We use secure payment systems from leading financial institutions in e-commerce. Payment details are confidential and transmitted in encrypted form (SSL) to the corresponding financial institution.

Credit card payments have an order processing time of 48 hours.

Scalapay: PURCHASE CONFIRMATION - If you purchase with Scalapay, you will receive your order and pay in 3 installments. You confirm that the installments will be sold and purchased by Retail Instalments SPV 1 Limited, its affiliates and beneficiaries, and you hereby unconditionally and irrevocably authorize and consent to this purchase and sale.

 

Right of withdrawal

The user has 15 calendar days from the date of receipt of the product to return it. This does not apply to products sold "in bulk or by the meter," such as fabrics, unless a complete piece is purchased. Unless the return is due to product defects, the user will be responsible for the shipping costs. In all cases, the product must be returned in its original packaging and in perfect condition. ON THE CONSEQUENCES OF WITHDRAWAL AND REVOCATION. In the event of a valid notification of withdrawal or revocation, the benefits received and any profits obtained (e.g., interest) must be returned to each other.

Should the buyer be unable to return the goods received in whole or in part, or only in a damaged condition, the buyer is obligated to compensate La Croixé BCN accordingly. Furthermore, to prevent liability for damage resulting from normal wear and tear, we recommend that you do not begin using the goods as if they were your own, avoiding anything that could diminish their value (thus, the products must be unused and undamaged, retain their original tags, and be returned in their original packaging). Returned goods should be sent to Guest Dress, SL, located at C/Tavern 50, 08006 Barcelona (Barcelona, ​​Spain), with shipping costs and at the recipient's risk. The obligation to refund payments and services will be fulfilled within a maximum of 30 days. This period begins for the buyer upon sending their notice of withdrawal or upon sending the goods back, and for La Croixé BCN upon receiving them.

 

Applicable guarantees

All of them have the warranty period in accordance with the criteria and conditions described in Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.

 

Data protection

The entity responsible for the online store for the purposes of regulations on the protection of personal data and regulations on electronic commerce is La Croixé BCN.

We will use your data only as permitted by law and based on your consent; especially if it relates to the receipt and fulfillment of your order (e.g., name, address, email, information about the items ordered/purchased, data about your ordering and payment behavior), as well as any other data that you voluntarily provide to us.

 

Applicable law and jurisdiction

These terms and conditions shall be governed by and construed in accordance with Spanish law in all matters not expressly provided for herein. The provider and the user agree to submit any dispute that may arise from the provision of the products or services covered by these Terms and Conditions to the Courts of the city of Barcelona.
